According to Atty. Trixie Cruz-Angeles, the Philippine republic don’t have the burden of proof because it is at the hands of the complainant who need to prove that there’s no available remedies in the country.

Atty. Angeles lectured VP Leni Robredo who happens to be lawyer, that the burden of proof should be the camp of Rep. Alejano, who should prove that the state has failed and its institutions have broken down to the point that no recourse is available locally to address the issues they bring to the International Criminal Court.

Mawalang galang na lang po, Ma’am, pero nabaligtad nyo yata. Hindi ang republika ang may burden na patunayan na umaandar ang sistema at bukas ang mga institusyon. Burden po yan ng nagsasabing walang available remedies dito sa bansa.

The statement of the veteran lawyer, Atty. Angeles came out on social media after a report posted by Politiko, wherein they interviewed VP Leni Robredo on what she can say about the dismissal of the impeachment complaint filed by Rep. Alejano against Pres. Duterte.

According to VP Leni, “There’s an even more pressing need for the country to prove its democratic institutions are working in light of the possibility that a fresh complaint may be filed against President Rodrigo Duterte before the International Criminal Court.

VP Leni added further that “no one can stop anyone from filing a case against Duterte before the ICC. She was quoted as saying “Tingin ko hindi mahihinto kahit sino na gusto mag-avail ng mga prosesong available. Pero siyempre sa atin, bilang bansa, mas gusto natin na ni-reresolve nating iyong mga problema on our own,” she said.
